My ex-husband and I divorced finishing year and I allowed him to stay surrounded by the house if he made the mortgage payments?
He has made only two payments surrounded by almost two years. I want to evict him for non payment and the house is about to move about into foreclosure. His name is on the deed, not on the loan. Can I do this?
Answers:
It all depends on how your divorce motion was written. In most cases the deed and or loan would own been required to be changed over to be in your entitle solely after the divorce was finalized. If you have the documentation to prove it is your home after your can start eviction procedures on him.
You're screwed! You both own the house. You can't kick him out. If I be you, I would get myself a realtor and see if you can get a short mart, before the bank forecloses on you.
Look at it this method, soon you will both have to move out of the house. Then you will finally be rid of him.
I think I would address to a lawyer and find out if there's anything you can do legally to force him to pay envelope you all the money he owes you. Next time you get a divorce. Have it state within the divorce papers who gets legal title of the house. If you choose to tolerate your ex live in your house with the agreement he will trademark the mortgage payments or pay rent, then capture it in writing, or tell him he have to get out.
Wow - he really showed you, didn't he? Should've split the assets when you have the chance - now he's ruined your credit and get a free place to stay...what a winner.
No. He owns the house. The deed is what constitutes who owns it. The loan is just for who's paying on it.
You want to contact a lawyer, if it's in foreclosure sounds close to you'll both be out soon enough!
ask a lawyer. why would you divorce someone and after have them live with you? sounds really crazy
