Construction loan to Permanant Mortgage sound out. Need Help.?

Been constructing new house with wife beside construction loan, about to turn into a permanant mortgage in a week, very soon wife threatning to leave and says she doesnt want to sign the mortgage, my sister have agreed to sign with me but I dont want to ask the bank if this is ok contained by fears it might scare them, does anybody now if the ridge would allow a different person to sign the permanant mortgage that was not on the construction loan?
Answers:
You need to see a real estate attorney, ASAP.

Problem #1:

If the wife won't sign, you may not be capable of sign either if you live in a "connubial interest" state...this is different from a "community property state"...if she doesn't sign, and her signature/income was on the approval of the loan, then BOTH of you can be sued for specific working.

Problem #2:

Your sister cannot sign without the bank's permission...they hold to credit qualify her. The bank, not the attorney, draws up the mortgage documents...all the attorney draws up is the HUD.

If you live contained by a marital interest state..she can't sign without your wife's authorization.

You need to see an attorney NOW b/c if you miss your closing date you can still be sued.
You'll have to reapply with the other soul on the loan. If your wife's income was instrumental in the loan approval, it's plausible going to be a problem.

Also, if your wife's not on the loan, you want to make darned sure papers are arranged so that she's not given any ownership interest in the house. It would really stink, if because you are married, and the house is bought during the conjugal, she automatically gets half interest contained by the divorce.

You probably need to consult a lawyer to numeral out how to do that.
I would talk next to the lender. However, the loan was approved based on adjectives the information that you AND YOUR WIFE gave. The bank would obligation to review and approve your sister.

first you need to quit claim your wife bad the house then add your sister.
create sure your sister will qualify for the loan and has no outstanding collections or judgments. you will call for an appraisal so make sure everything is finished on the house. if you and your sister qualify and the house has the effectiveness you will have no problem.
I do not know, but I doubt they will shift for this.
