Can I lawfully break into my own home if someone's is not paying the mortgage?

I've been away from my wife now since October of 2007. We never file for a divorce, mainly because of monetary reasons contained by my opinion. I guess neither one of us wanted to take-home pay for it. So; she lives in the house which is in my christen with her mother. I told them as long as they pay the mortgage which is contained by my name only they can stay nearby, otherwise I would sell it. They agreed to stay and do just that. Recently I tried to win credit and the house showed up that it’s delinquent. I found out from my daughter that they were gradually moving things support to the apartment building that her mother owns. The problem is she tried to get control of the house and could’t so now they are letting the house budge into foreclose. What can I do to get back into my house to try and recover it. Legally I can move back in can’t I? I will do anything I need to in directive to get the house back within good standing so that I can sell it and try to salvage my credit. I will rent rooms out if I enjoy to. What can I do?

You need to call the mound and tell them what is going on as soon as possible. They will have an answer for you. After it go so far there is nothing you can do.
The first thing i would do is go and want legal aid and then run down to your local police station explain the situation and ask them. Maybe it would be best if you went and filed for divorce. I know it will cost a bit bit but it would be for the best.
Seek legal council! I believe the house is your sole responsibility, and your wife, if she be smarter, would b doing everything possible to keep the house as it would get taken from you by the ridge and sold for what is left owing! with this contained by mind you both loose out, if you legally separated and then divorced she would be entitled to more of a cut of the property. no property, no money for any of you, plus you get a bad credit rating! Do something in a minute before it's too late!! hide away the house and see what you can legally do to get her out of the picture. Look after yourself!! And I'm feminine!
Well sure you can move fund in. It's YOUR house !! I would march my little bootie over, plenty in hand, and budge right in make myself at home. I would build her life miserable. You really can't demand that she leave-since ya'll are still married-but I'm sure she won't resembling the idea of living with you. Heck, invite a few friends for a group! ;)

Unfortunately, you WILL have to catch the payments up. Call your lender and I'm sure they will work something out next to you. They don't want the house ~ they want your money. They will work with you I'm sure.

of COURSE you can move back in.... the house surrounded by in YOUR name singular so it's YOUR HOUSE only.... the sad piece is that she has screwed up your credit by not making the mortgage payments... you will have to clear up those payments as soon as possible PRIOR to the house going into foreclosure. You have NO legal papers maxim she has the right to even live in the house so I would progress to the house and tell her you are taking the house and give her a week to move out of the house... she can clash it BUT, if you bought the house PRIOR TO THE MARRIAGE, she can do nothing about it.... she loses.... you MAY both own to end up getting a lawyer so be prepared for that expense as capably.
