Split from girlfriend, we own cohesive mortgage, she will not allow me spinal column surrounded by home what are my rights?

my ex partner still expects me to pay half the mortgage and adjectives the bills, am i legally expected to do so if she is not allowing me access to my home?
Answers:
Well this is a sticky situation because, you are on the mortgage. Yes,you could stop paying, but,it will eventually show on your credit if she were to stop paying as very well. Best thing to do is call a legal representative and see what can be done. I do not think she has the right to hold you out of the home though, unless you are a threat.
Dont mess up your credit rating! You could enjoy real problems obtaining a mortgage within the future. You are not legally bound to hang on to paying the mortgage - it is your choice, but it is your property too and you are entitlted to half the equity in the house, any you'll have to sell it or she will enjoy to buy you out. You can get a police escort to collect your belongings and you could stop paying the bills. But before you do this - only just think just because she's person a b*tch doesn't mean you have to be!! You can be the bigger man and surface all smug when she's forced to sell the house lol. Go see a solicitor asap.
Honestly, go see a soliciter you'll never go and get the proper advice u need on here. and the longer you make tracks it the worse it will become......
Make her buy your half or go up and split the money. Dont give her a penny more.
Legally, if your describe is still on the deeds then you have right of access.
If you don't live there, why would you compensate for it? I wouldn't pay her a penny mate.
You are legally responsible to reward for at least half the mortgage even though you don't live in that. Your mortgage lender will tell you this. You signed a legal contract when you took the mortgage out.

You do not how ever hold to pay for the bills.

If she continues you both have no picking but to sell the house. You are entitled to half the effectiveness (unless you have children, then its 40%)

So see a solicitor, most set aside free advice.

Good luck Source(s): In the same situation
You have the right to contact an attorney. He will support you of the laws in your nouns. If she refuses to allow you access to the property, the law may force her to buy you out or may force the public sale of the property. Some of this depends on how you two set up the deed. There are attorneys who specialize in valid estate law. You want to be careful so you don't catch a black mark on your credit report because of this.
Why do you have a joint mortgage if you're not married? That wasn't drastically smart in the first place.
You need a good attorney for this one.
No you are not expected to do so. What I would suggest is to see the CAB (Citizens Advice Bureau) who will probably be able to put you contained by contact with a solicitor free of charge who will be able to push for you on the best way forward.
See your solicitor, i'm sure you enjoy rights.
Oh you do want to pay and trademark sure she is too. YOUR credit can be ruined by that. Make sure those mortgage payments are made.

You need a lawyer to help out you with what you legally can do. You may hold to sell the house or she could buy out your share and refinance or you could buy the house and refinance. Talk to an attorney.

A copy of your mortgage papers taken to the police department will get them to usher you into the home to collect personal items. But this is a temporary thing because they wont maintain coming back so you can get adjectives of your stuff.'

Are the utility bills in your name? If so you could shut them stale, while you are on there tell them that you are the owner of the house and not a soul else is allowed to turn on the utilities. She will eventually get them to do it but its a long process.
Yes you are obligated to pay as all right as obligated to live there! You have a short time ago as much right to the house as she does. Who died and left her queen of the throne?
If you live here or not and you dont pay your half of the mortgage if and when the house go up for sale you wont get a penny but if you recompense your half or at least contribute you ll be entitled to partially of everything.
OK a mortgage is irrelevant it is just a loan secured by the property
the question is are you on the title
in that is a very complicate bit of law here, necessarily the possessor has the right to undisturbed possession, when you departed you are no longer the possessor so you have no right of abode

OK if you stop paying that will force her out however it might make problems near your lender and credit rating

mind you a couple of late payments might focus her mind and not make your credit rating too impossible

you can go to court and get an decree to sell the property
You hold the right to live there if you are paying half. Contact a solicitor for proposal, you shouldn't stop paying for it as that may go against you.
She has no right to not tolerate you in the house. You own half. Go to the police and own them go with you to draw from into that house...then you go draw from a lawyer.
no dont pay her !
if ur disallowed into the house then its not ur issue !
dont give her a penny and stop adjectives direct debits for bills in ur term !!
that will teach her a lesson !!
is it YOUR home?
You have equitable and Legal rights to that house, contained by effect you own half of it and are entitled to half of the gratification and benifit of that house. A) you were silly to get a integrated mortgage......when you learn the law you revise not to get a joint anything. Refuse to income anything, she can release you of your equitable status on the house by coming up with your interest and putting it on trust for you. B) consult a good soliciter, this could return with very messy.
But whatever happen, legally you own half of that house and she must by statute repay you. Source(s): I'm a law type person.
explain to her in no ucertain terms to grasp stuffed you dont live their why should you pay for any thing dont be a wimp stand your ground see a solicitor and verbs the rug from under her feet put up for sale the house and get your share your entitled to it she is a ***** and a user dont let her use you any more carry your money back shes walking all over you STOP IT NOW AND RID OF HER FOR GOOD SHE IS A SLEEZE BAG OF THE HIGHEST ORDER .
mortgage is a type of contract.
before answering one should travel through the papers.
therefore you contact one lawyear - who explains you the matter& your liability on it.
if she forcedly restrict you to go outside, help yourself to help of local police. she has no such rights.it is a defilement of human rights.
if you are intern by her, and not able to comeout then, publish your actual christen, address & mobile number through internet or yahoo.i hope someone will come forward to help you.
You are only responsible for your share of the mortgage. The utilities are her problem. If they are in your identify, have them cut off.

You can carry an attorney and take her to court to force her to either supply and give you your half of the equity, or buy you out.
