Obtain Mortgage lacking Certificate of Occupancy? Code violation and fruitless tenant.?

We are in a lease/option, for a house that was physically moved during our residence (we were out for about 2 months). We re-entered the house within October and resumed paying rent. It's now May, and it's time to start negotiations for buying the house. We of late found out that not only is there no card of occupancy on the house, but there are several code violation that will prevent one from being issued. AND, the landlord really have no intentions of fixing them. We wouldn't mind buying the house and fixing these things ourselves (reducing purchase price considerably) but what legal ramifications are within, and can we still get the mortgage? Plus, are the legally allowed to be accepting rent from us?

House must be up to code (even if the code provides for simple things approaching access ways and need for another door. No cert of occ. and big big no no. The single legal Way to get a mortgage reduced within half!
You simply require the house be brought up to code before you can buy it. He may not be happy around it, but he MUST fix them to sell or rent the house.

Don't worry in the region of whether it is illegal for him to accept rent, YOU are breaking the ruling by living there. If you rat him out you will be exposing yourself to fines/penalties, as well.
Sure he can adopt rent, you are living in his property.

He simply can not sell or refinance the house, unless he sell to to someone who has obtained a construction loan.

You can singular buy it as is if you qualify for a construction loan, which requires a sizable down given to the bank you are borrowing from. (25% of the loan) and you have to refinance it into a regular loan in a few months.
If the house is not up to code, you will not be able to get a mortgage on the property.
