Can i sue my mortgage company? they enjoy miss applied my funds and in a minute I own a doomed to failure credit rating?

My mortgage was sold to this goofy outfit named homecomings financial only just and I never got anything in the communication other than a "hi, we bought your loan, send your payments to us" communication.

Since then, this company has taken out forced placed insurance on my loan (without sending me letters) because they did not receive any insurance information when the loan be sold. So they tapped my escrow for almost $1200.00 for one of their bogus policies to cover my house. I have have my house insured since I bought it 3 years ago and up until recently, it has be sold on average every six months. This is the first time I have played this cat and mouse crap.

I made my april payment and immediately they are rating my credit as one month past due because they applied my payment to the escrow for which they tap for the fpi. I have provided my coverage to them from state farm going on 2 weeks ago.

Can I sue for them rating my credit as 1 month departed due? THEY FREAKIN OWE ME 4 THE FPI! IDIOTS

ok it sounds similar to they are not speaking to your demands, getting a private attorney involved would be silly at this point. You need to first call these population up again and talk to a manager explain your overnight case, tell them you have adjectives the evidance infront of you claiming you have homeowners insurance. Tell them if this is not resolved in 48 hrs you are going to contact someone next to legal power. I bet the will shape up, you may need to fax them your insurance policies. If this dose not catch taken care of in that time frame, dispatch in all of your proof and credit report and a missive of timeline of events to your states attorney generals office. Tell the attorney generals office you face hardship with this. this will be cleared up hurried. good luck i had to run around providing insurance but it did not win that bad,

I believe this should be handled by an attorney....could go and get involved...go contingent....the lawyer get half and you get partly....sue the crap out of them.....good luck
Homecomings is a GMAC owned company and I wouldn't waste my time trying to sue them.

Instead I'd contact the better business bureau and the credit bureaus. NO business wants a complaint shown on their bbb profile.

Let them both know what's going on, and find out what would be the best bearing to handle it. Chances are after a few conference calls they'll enjoy it removed.

the first thing you should do is brand name a plan of what you want and what is real. contact a lawyer roughly speaking the credit problem.the lawyer can advise you on what roadway to take.the lawyer can contact the company and they can remove the distrustful info from you file.do not play the cat an mouse game. your a defeater.
